ElcomSoft Prevails Over DMCA

The DMCA (Digital Millennium Copyright Act) has received the first of hopefully many kinks in its armor. A jury today found ElcomSoft not guilty on criminal charges that it produced a program that cracks anti-piracy protection on e-books.

"Jury foreman Dennis Strader said the jurors agreed ElcomSoft's product was illegal but acquitted the company because they believed the company didn't mean to violate the law.

"We didn't understand why a million dollar company would put on their Web page an illegal thing that would (ruin) their whole business if they were caught," he said in an interview following the verdict."

Although this isn't a green light for programmers to start cracking away at copy protection schemes, it sets the precedent for limiting the actions of over-zealous copyright holders. You can read more on this story here.
