Court Rejects Sharman Claims

As US court has ruled on Sharman's attempts to get the FastTrack case expanded to include antitrust against the music labels.
Sharman said that the music industry were withholding licenses from kazaa.
However, Judge Wilson said "Sharman is neither a competitor nor a customer in that market, and any injuries would be incidental, not integral, to the alleged anticompetitive scheme"
Many viewed this attempt by Sharman as an attempt by Sharman to prolong the lawsuit for as long as possible. By following this strategy they may have thought that the RIAA would be more likely to settle with them. Sharman have previously said that the lawsuit may go on till 2005.
Several key rulings are still due in the FastTrack case. They include a ruling in the RIAA appeal of the Grokster/Streamcast decision and the RIAA's attempt for their own summary judgement.
