The Free Software Foundation has announced that it has established an Expert Witness Defense Fund to assist defendants in RIAA cases, in order "to help provide computer expert witnesses to combat RIAA's ongoing lawsuits, and to defend against the RIAA's attempt to redefine copyright law."

How are they attempting to "redefine copyright law" ?

By making up a theory that it is a copyright infringement to "make files available", even though there is nothing in the Copyright Act that says anything like that. For a good explanation of the perniciousness of that theory, and the danger it poses to the internet, read the amicus curiae brief of the US Internet Industry Association and Computer & Communications Industry Association in Elektra v. Barker.
