Tanya Andersen's Motion for Attorneys Fees Granted by Magis

Tanya Andersen's attorneys fees motion in Atlantic v. Andersen has been granted by the Magistrate Judge to whom the question was referred. U.S. Magistrate Judge Donald C. Ashmanskas issued a 15-page decision in which he ruled as follows:

defendant incurred substantial fees before the claims against her were dismissed, including those incurred to file her motion for summary judgment and to respond to a motion to dismiss her counterclaims with prejudice. During that time, plaintiffs were either unable to obtain, or chose not to produce, significant evidence to support their claims.....when plaintiffs dismissed their claims in June 2007, they apparently had no more material evidence to support their claims than they did when they first contacted defendant in February 2005.....


Reminds me of a bully who is getting what is deserved.

Finally, someone in the legal system said "F.U" to the common idea of delaying and extending the whole process, draining the defendants money without actually having to prove anything.

It's tragic that she should have to fight so hard, just to recover her fees.

Let's hope she can use this inertia to push for some truly collosal damages, to compensate for having to endure two and a half years of totally unjustified suffering.

Wonder where the RIAA's money comes from... Maybe they should stop complaining about students downloading a few songs, and start looking at how much money they spend taking people to court and having to pay fees like this....

But good for her :D

Well it is a class action suit.

But it will probably take a long time to work its way through the Court.
