that is very interesting. Has anyone actually had a letter from TBI sayingthey are dropping the case? I have heard nothing since my second letter (dated early march) which was a response to my first LOD. I dont know hwo long they usually take to correspond again

Well I don't anticipate they will be writing to anyone, that might be what a reputable law firm does but this firm is not a reputable law firm. Reputable solicitors do not carry out volume litigation from harvested data. TBI have shot themselves in the foot and now hold the muzzle to the roof of their mouth. The reason? what other motive but money...

the other law firms didnt bother to send out letters saying they had stopped persuing people, a few people have posted saying DL sent them a letter saying they were dropping it, but a lot have not received anything (including myself).

id consider it over if you dont hear anything else, its a shame this saga will stay with you for some time after though, (im still lurking on here even tho i got my first letter 2 years ago).

TBI always handled themselves slightly differently to ACS at least. The first letter was ultra-agressive and had several very clear serious breaches of SRA regulations within it. Once challenged they seemed to have very little fight in them whatsoever, sending out very muddled insipid replies.

However, I agree - I very much doubt that those with open cases with TBI will hear of their cases being dropped, if they are. Don't forget this is in theory all done on the say so of the rights holders. It is the rights holders who have another 6 years to make your life a misery and the rights holders who could simply employ another solicitor to carry out the work for them... I wonder who they'd choose. Perhaps one who has recently written a letter / advertisement boasting "1 million for the the rights holders". It might not happen, but You never know. It's not as if the porn copanies have a reputation to protect.
Don't take rubbish from ACS:Law / Digiprotect / Logistep lying down. Go to Beingthreatened.com for advice and help others out by meeting your MP and filling out the statistics form! This scheme will not stop unless you are willing to contribute.

So were TBIs letters flawed to begin with because they didnt follow the wording of the part 36 to the letter- e.g citing 14 days instead of 21? Do youthink this is why they backed off? or do they find their association with porn companies a blight on their reputation.
I have had an acknowledgement from the SRA that they will assign my case now to a case worker.
I just cant bear to be left hanging for the guts of six years.
I am furious as hell now after spending the last month or letting the whole thing affect my life so badly.

Looks like TBI law's bullying is over, but how can they be surprised? They obviously have no respect for the solicitors code let alone the basic rights of the people they have pursued. I hope the pornographers moll thinks it worth it, but what did she expect, that people would pay up and thank them for their "clients" generosity?

TBI Statement:
"We have been surprised and disappointed at the amount of adverse publicity that our firm has attracted in relation to this work and the extra time and resources that have been required to deal solely with this issue.
We are concerned that the adverse publicity could affect other areas of our practice and therefore following discussions with our clients, we have reluctantly agreed that we will cease sending out further letters of claim.
We should stress that this decision is based on purely commercial reasons and does not alter our view that our conduct has always complied with the Solicitors Code of Conduct (SCoC).

There has been a recent development regarding one of our Slyck members:

Lawyers Warn WordPress Over File-Sharing News Blog

http://torrentfreak.com/lawyers-warn-wo ... og-100610/

A law firm which previously sent threatening letters to alleged file-sharers in order to receive cash settlements has complained to WordPress over a hosted blog. According to the complaint, Automattic Inc. can be held liable for copyright infringement and defamation due to the fact it hosted a FaceBook-sourced picture of one of the firm’s lawyers which had been Photoshopped into a ‘Wanted’ poster.
Interestingly, TBI then threatened to use a Norwich Pharamacal Order against Automattic, Inc. to obtain the identity of Hickster – the same technique it used to obtain the identities of alleged file-sharers – so it can take further action against him. Although the WordPress operator took down the image, it isn’t going to play games with their users’ identities.

“We only dealt with the DMCA notice contained within the e-mail sent to us,” said WordPress in correspondence. “We will not, under any circumstance, disclose any contact/personal/private details of our bloggers without a U.S. Court Order, and this has not been presented to us.”

This isn’t the first time that Hickster’s actions have drawn the attention of lawyers acting against file-sharers in the UK. He was named in the legal threat made by ACS:Law to file-sharing forum Slyck.com earlier this year, after he referred to a law firm employee as “a wanker“

oh god these firms are so dumb. Honestly they need to get a life, and throw their energy into something a bit more worthwhile.

This litigious arrogance might work in States, but it ain't going to work here, thank god.

On a side note I'd love to get one of these letters six months ago and reply back and say ' yes come and get my house which I don't own, oh and my stuff which is almost worthless, and which an official receiver would write off as reasonable assets, and and by the way I should let you know I'm a registered bankrupt.'

considering what is going on in england right now with these companies, i'd say labeling the US as the home of "litigious arrogance" is - well, an idea of questionable merit ;)

at least here, when someone asks for thousands of names to go with a spreadsheet of IP addresses in order to be able to try to extort money from people, the courts say nah ah. :P

(at least for now)
