ACS have won, if someone sends me the links and letters I would be happy to host the site. I'm not scared of them.

What is even wrong with that site it doesn't do anything wrong being scammed ffs why did you take it down. Did they threaten you with legal action, I cant see much wrong with the site.

What we need is about 10 sites all hosted off foreign servers that way they cannot shut them down.

Or we can carefully word them so it is legal we don't even need to write ACS in the site you could write "a company" :P

He'll probably change anything he's been forced to and then tell us what went on I guess. Prehaps the problem was that he should'nt have posted a contact email address. tbh they would have asked[threatened] his webhost to terminate his account and most hosts roll-over to legal threats.

You haven’t looked at the whois record for beingscammed.com, have you? :? ACS:Law could have walked around and served papers in person. I sense an undergraduate student trying his very best, but learning the hard way.

This really makes me laugh...........ACS:Law have had the Beingscammed website taken down........are they really that stupid that they don’t think another website with a less controversial name wont be set up with exactly the same info on it.
It will still have the same tags for all the search engines, just a different name. How does feellikeyourbeingscammed.com sound to them.

The good thing to come out of it is that they have had to waste some of their time doing it and I for one drink to that. :toast:

So this whole fiasco takes a turn for the worse or the better...seems to me they are now gearing up for an offensive and probably try and work out who are using the boards a lot and go after them first to make "examples".

Stressed to death as it is over this whole damn thing and boils my piss that in this Country people are allowed to threaten honest genuine hard working folk with this utter bollox without any hard CLEAR evidence

I just had an angry chat with some guy at Virgin for selling my details to these people in the middle of last year without telling me anything about it. The guy got quite aggressive, saying they were forced by the court order to hand my details on but were not paid for doing so, and that the court order stipulated that they must not inform me of their actions. I said I was going to change ISPs as soon as my current contract with them expires (in August) and he said that no matter who I go with, all ISPs are required by law to comply with these court orders.

Does anyone know if this is true, or if any ISPs are prepared to fight to protect their customers' details? Or do any, at the very least, let you know that they have been forced to hand over your details so you can prepare for what's coming?

The point is that if I had known this was going on this time last year, I could have made sure my router was secure back then. As it is, the settings on the router have been giving every Tom, Dick and Harry access to my network for a further twelve months so who knows what other stuff I might get accused of.

rodent: needless to say, it's probably not a good idea to take anything a low-level employee tells you as gospel, for many reasons. in particular, i find it difficult to believe that the court ordered virgin to not tell their customers about the release of the info. i think the most likely thing is that the court makes no stipulation about informing customers, one way or the other. i'm reasonably sure they neither tell them to inform you, nor tell them to not inform you.

Thanks Fred. But could DL/ACS:Law have inserted such a clause into the court order because they wanted to keep the alleged filesharer in ignorance during the period between them obtaining the IP address (last year) and issuing their letters of claim (now)? That way, they'd be more likely to pick up further offences in the interim period and so enable them to make more claims against the same individuals in the future.

rodent: i'm not a lawyer, so all i can do is speculate. my best guess is that no, they couldn't get any such clause approved by the court. hopefully someone with more specific knowledge of the laws in england can either confirm or deny that.

as far as making further claims go: i think the only people who need to worry about that are the people who signed the so-called undertaking. imo, these people have left themselves open to future harrassment.
