A ed2k/Overnet/Kad Security Question

If you upload something/download something and your ip is logged by whomever and later or whatever the mpaa, riaa, authorities, or whomever try to come after you, if you don't have anything to show them such as the file itself, can you still get into trouble? Ie: you have no file or whatever so how could it be you since the file they are after or whatever you don't have at the time of siezure?

does not matter if you have the file anymore all they would have to do is show you u/l the file using logs deleting the file later will have no impact legally

but what about if you live in an apartment complex and anyone could have used ur ip? Logs should have no impact because I can create logs using whatever program if I wanted but no file shold equal nothing.

yes, you could create a log yourself, which contained anything you wanted it to contain. however, in this situation, a reasonable person could easily assume you had reason to cover your ass, and not report the truth. there is no reason to assume that an ISP would deliberately fabricate a log, and so that log would have a lot more credibility. it's up to a judge or a jury to decide for themselves how believeable evidence is.

as for being in an apartment complex - huh? does everyone in the complex share a common ip address?

and when you say no file should equal nothing, remember that plaintiffs in these cases often request seizure of the PC in question, for the ability to perform a forensic examination of its drive(s) - so simply deleting a file is a weak defense.

Window Washer with Free Disk Space Wash should solve the forensic evidence problem if you happen to download a bad file or something and delete it. I was saying that in the apartment complex, if I broadcast my ip open (wireless)and someone used my ip and got into something that they shouldn't have, they could take my pc and if I didn't do whatever it was, no problem right?

i don't know how thorough that program is. many programs which claim to remove things from a drive don't do a good enough job - i don't know if that program is one of those or not.

as for the "plausable deniability" of an open wireless network - that's an issue for a judge or jury to decide. they might decide in your favor - or they might not...

Don't believe the hype mate. There is only one way I know of to remove things permanantly from your hdd and that is a low level format which unlike other things sets the drive back to factory settings (all 0s in other words) the others just write over something a certain number of times. This can still be gotten around with the right programmes.

You will be liable anyway it is your reponsability to make sure your network is secure. In many countries ignorance is no defence. That's why many higher education institues ban the use of p2p as they will be liable for anything downloaded, the same applies to joe/joan public.

You either download and be logged, or dont download and dont worry.

Everything you download is logged, whether we like it or not. Our ISPS hold our dear lifes future in their hands, esp people like (me) who since the age of 12 have enjoyed "downloading"

The miniscule small percentage of people caught is nothing compared the the large picture, just dont get caught...

This gun shoots into both directions, those are civil courts, you know? The *AAs know that and their only witness are usually the filenames, the count of lawyers and the intelligence level (or better to say, the lack of) (or better the will to learn - better the lack of) of the judge.
Windows? Blah. Linux? Blah. BSD? Blah.
Just make sure you have a computer licence and I can open your fsckin files.
